How Does a Wrongful Death Lawsuit Work?

In Florida, only the personal representative of the deceased’s estate may bring a wrongful death claim; although family members can recover compensation in the lawsuit, only the personal representative of the estate can actually file it. The personal representative could be someone named in the deceased’s will or it could be someone appointed by the court if there is no will.

The process begins with the filing of the wrongful death claim. This must be done within two years of the date of death (with some rare exceptions). This is known as the statute of limitations, and failing to file the wrongful death lawsuit within the statute of limitations will bar the estate/family of the deceased from recovering damages. Additionally, the claim must be filed within the right jurisdiction; a wrongful death attorney can help determine which court has jurisdiction over the case. The lawsuit must also include a list of all surviving family members and/or dependents who have an interest in the suit. This could include the deceased’s spouse, children, parents, and others.

After filing the lawsuit, the personal representative (or their attorney) will need to notify the defendant of the allegations. This is known as “service of process.” Following the service of process, the discovery phase begins. Discovery involves both sides—the plaintiff and the defendant—requesting information from the other. During discovery, you may be required to provide evidence to the defendant and vice versa.

At any point, the two opposing sides may attempt to settle the case through mediation, arbitration, or some other form of alternative dispute resolution. This is a way to avoid litigation and the cost, time, and stress of going to trial. However, settlement is not always possible; your case may proceed to litigation. If this is the case, the trial will begin at the conclusion of the discovery phase. At trial, both sides present evidence to support their claims, which may include witness testimony, cross-examination, and more. The case will be decided by a judge or jury. In some cases, one of the involved parties can file a motion for summary judgment, which is essentially a request to have the case decided by a judge instead of a jury.
